Terms of Use

1. Acceptance of Terms

By accessing or using the Crossborderify platform, you agree to be bound by these Terms of Use. Crossborderify provides a technological bridge (SaaS tool) for visual product search, supplier access, cross-border logistics infrastructure, and Shopify store integrations.

2. Platform Nature & Context

Crossborderify operates strictly as an intermediary software provider connecting merchants with global suppliers. We are not a direct seller, manufacturer, or shipping carrier. Our services facilitate access to third-party ecosystems, but we do not take possession of, or hold title to, the goods transacted through the platform.

3. Disclaimer of Warranties & Limitation of Liability

The Crossborderify services are provided on an "as-is" and "as-available" basis without any warranties of any kind, either express or implied.

To the fullest extent permitted by applicable law, Crossborderify disclaims all warranties. In no event shall Crossborderify, its directors, employees, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your access to or use of the service.

4. Operational Responsibilities & Third-Party Risks

The platform relies on third-party integrations (such as Shopify API, Taobao, Alibaba, various carriers). Responsibility for commercial and logistical operations depends on the chosen operational model:

  • System-Managed Operations: If you explicitly mandate the platform to manage the complete end-to-end operational process, Crossborderify will actively oversee the workflows and assume the applicable responsibilities to resolve disputes with your end customers.
  • Independent Operations: If you elect to use independent origin or destination operation teams operating outside of our system's control, Crossborderify strictly disclaims any liability for supply chain defaults, supplier discrepancies, customs issues, delivery failures, or commercial disputes between you and your end customers.
  • Technical Integrations: Outages or technical failures from external third-party APIs (e.g., Shopify downtime) remain outside our direct control and liability.

Any assumption of operational risks applies only when operations are explicitly delegated to and managed directly by the platform.

5. Account Cancellation & Refund Policy

Crossborderify reserves the absolute right to terminate or suspend operations and user accounts at any time for violations of these terms. Due to the nature of our technological infrastructure and API consumptions, all subscription fees and service charges are generally non-refundable unless strictly required by applicable mandatory laws. Refund requests undergo strict evaluation solely at the discretion of Crossborderify.

6. Modifications to Terms

We reserve the right to modify these Terms of Use at any time. Continued use of the platform after any such changes constitutes your consent to such changes.
